TERMS AND CONDITIONS OF SITE USE
Welcome to the official ticket site of The Football Association (“The FA”), through which a Charter Standard Club or Charter Standard School (the “Applicant Club/School” or “you”)) can register to enter ballot(s) (each a “Ballot”) to be selected to be allocated tickets for men’s senior international matches at Wembley Stadium (each a “Match”).
The following conditions (the "Terms") govern use of this website ("Site"), registration for a Ballot and any tickets a Charter Standard Club or Charter Standard School purchase as a result of a Ballot (the “Tickets”). By using or visiting the Site, you expressly agree to these Terms and to comply with all applicable laws and regulations governing the Site, the Ballots and any Tickets you purchase (including ‘The FA Match Tickets – Conditions of Use’ accessible via the attached link and you agree to bring all such conditions to the attention of the individuals to whom any Tickets are allocated.
The FA reserves the right to change these Terms at any time, effective immediately upon the sooner of their being posted on the Site or otherwise being made known to you.
If you breach or act otherwise in accordance with these Terms, The FA may terminate your use of the Site, bar you from future use of the Site, cancel your entry into any Ballot or any subsequent order for Tickets, bar you from receiving future allocations of tickets to FA matches and/or take such legal or other action against you as it may, in its sole discretion, consider appropriate.
PLEASE READ THE FOLLOWING TERMS CAREFULLY AND PLEASE CEASE TO USE SITE AND DO NOT CONTINUE OR PURCHASE TICKETS IF YOU DO NOT AGREE TO ANY OF THEM. BY USING THIS SITE YOU AGREE TO BE BOUND BY THESE TERMS.
1 The Ballots
The provisions of this Paragraph 2 shall only apply to applicant club/schools who are successful in a Ballot and are allocated Tickets.
2.3 Admission to Matches
3 Data Protection
3.1 The FA will only use personal information for marketing or other purposes unrelated to the Ballot you have entered where required to by law or to the extent otherwise permitted under consents to such use given in your application.
4 Permitted Use of the Site
You agree that you are only authorised to visit, view and to retain copies of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any other purpose.
5 Functioning of the Site
The FA does not promise that use of the Site will be error-free or uninterrupted. The Site is delivered on an ‘as is’ and ‘as available’ basis. The FA cannot ensure that files you download from the Site will be free of viruses or contamination or any other thing that may cause damage to your own computer, technology or software. The FA makes no warranties, express or implied, as to fitness of the Site for a particular user’s purpose.
6 Limitation of Liability
6.1 Other than where expressly stated otherwise in these Terms and to the extent permitted by law, The FA will not be liable for any damages, losses or expenses of any kind arising from the use of this Site, including without limitation, direct, indirect, incidental, and punitive and consequential damages. For the avoidance of doubt, The FA shall not be liable for any costs, expenses or losses incurred for travel and accommodation in relation to any Match.
6.2 To the extent permitted by law, The FA excludes any liability for any loss, injury or damage to persons or property in or around the stadium.
6.3 The FA shall not be liable for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with the Site, any Ballot, any Tickets purchased or any Match. The FA shall not be liable or responsible for any matter that is beyond their reasonable control.
6.4 Nothing in these Terms shall operate to limit the liability of The FA for death or personal injury caused by The FA’s negligence, or for any fraudulent misrepresentation made by The FA.
7 Ownership of Site Materials
7.1 The FA logos, including without limitation The FA Crest, found on this Site are registered trade marks of The FA. The FA's trade marks may be used only with the express prior written consent of The FA. The FA is committed to actively defending its intellectual property rights and will take legal proceedings in the pursuit of doing so.
7.2 All materials on this Site are protected by copyright law and may not be reproduced, copied, edited, published, transmitted or uploaded in any way without The FA's express written permission. The FA does not grant any express or implied right to you in relation to any of its trademarks, copyrights or other proprietary information.
8.1. Although The FA cannot always monitor the conduct of users of this Site off the Site, it shall be a breach of these Terms to use any information or Tickets obtained from this Site for any illegal purpose, or in a method which The FA considers in its sole discretion to be contrary to either the interests of the national game of football or The FA’s own legitimate interests.
8.2 You are reminded that s.166 of the Criminal Justice and Public Order Act 1994 (as amended by the Violent Crime Reduction Act 2006) makes it is a criminal offence for an unauthorised person to sell a ticket to a designated football match or otherwise dispose of such a ticket to another person. For the avoidance of doubt, this includes the re-sale of Tickets at a price above that at which they were purchased through this Site.
8.3 No area of this Site may be used for any commercial purposes including without limitation, the sale of tickets to third parties. We reserve the right to block access to the Site, to cancel registration for a Ballot or any application or order for Tickets and/or bar you from receiving future allocations of tickets for FA matches if you do not use this Site or any Tickets solely for your personal use or if you are known or reasonably suspected to be associated with any person, agency or company involved in the unauthorised sale of tickets to FA matches.
9 Access and Interference
9.1 You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper operation and running of the Site. You agree that you will not take any course of action or do any other thing that imposes an unreasonable or disproportionately large load on The FA’s web-based infrastructure.
10 Effect of a Breach of these Terms
You understand and agree that in The FA's sole discretion, and without prior notice, The FA may terminate your access to the Site, cancel your registration for any Ballot, cancel any Ticket order, cancel your englandfans membership or exercise any other remedy available to it if The FA reasonably believes that you have acted in breach of any of these Terms.
You agree that monetary damages may not provide a sufficient remedy to The FA for breach of these Terms and that The FA may seek injunctive or other equitable relief without the need for proof of special damage.
You agree to indemnify and hold The FA, it subsidiaries, affiliates, officers, agents and other partners and employees harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of this Site.
The FA shall not be required to refund any sums to you if you have any order or application for Tickets cancelled, due to your breach of these Terms.
11.1 This site is controlled and operated by The FA. Any dispute about or involving the Site, any Member, Match or Tickets in connection with use of the Site, any Ballot or Tickets obtained therefrom will be governed and construed in accordance with English Law, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
12.1 If in any particular case any of these Terms shall be or be held to be invalid or shall not apply to the Contract the other Terms shall continue in full force and effect.
12.2 The FA shall be entitled to cancel a Ballot or any order for and delivery of Tickets if and to the extent that it is prevented from or hindered in or delayed in doing so by any circumstances beyond its control.
