The Chancellor ruled that as a licensed players' agent, Mr Stretford is bound by The FA’s Rules and regulations and in particular is bound by the arbitration procedure set out under FA Rule K.

As a licensed agent it is Mr Stretford’s duty to keep himself informed of the content of The FA Rules.

The Chancellor also rejected Mr Stretford’s claim that The FA’s arbitration procedure conflicts with Article 6 of the European Convention on Human Rights (the right to a fair trial) or the principles of natural justice.

He concluded that FA Rule K meant that Mr Stretford could not bring the court proceedings, and refused Mr Stretford’s application for permission to appeal against the judgment (although Mr Stretford is entitled to ask the Court of Appeal for permission). The FA will oppose any such application that Mr Stretford makes.

On this basis Mr Stretford will have to proceed by arbitration in accordance with the procedure set out in FA Rule K.
